  1. I have reviewed your query regarding the rejection of your EPS Higher Pension application owing to incorrect information submitted by your previous employer and their failure to rectify it before the deadline of 31st January 2025.

This is an increasingly common issue faced by employees, and unfortunately, the EPFO portal does not presently provide a direct route for employees to make corrections independently where employer approval is mandatory.

However, all is not lost. Here are your possible remedies:

File a formal representation to the concerned EPFO Office
Immediately send a written complaint to the Regional Provident Fund Commissioner, narrating the entire sequence and enclosing proof of employer inaction (email follow-ups, rejection notice, etc.). Request reopening of your EPS application under principles of natural justice, citing that the lapse was on the part of the employer.

Issue Legal Notice to the Employer
Send a legal notice to your previous employer holding them accountable for dereliction of duty and seek their cooperation in submitting the corrected joint declaration. This adds pressure and may speed up the process.

    Writ Petition before High Court
If the EPFO fails to act or your employer remains uncooperative, you can file a Writ Petition under Article 226 before the jurisdictional High Court seeking a direction to EPFO to accept your corrected application. Precedents from Kerala, Madras, and Delhi High Courts support employee rights in similar contexts.

Since your right to higher pension is a vested right once opted within the prescribed time, denial on technical grounds caused by a third party (employer) may not stand judicial scrutiny.

We can assist with drafting the necessary representation, legal notice, or Writ Petition based on your next step.

  2. Dear Sir/Madam
My previous employer had submitted incorrect information to EPFO on the application on EPS on higher pension, the application was rejected. Despite several follow-up, employer has not submitted the corrections within 31st Jan 25. Is there a way to get any remedy. Pls advise.
